Terms of Service for Signature Services
Effective as of April 17, 2025
Welcome. We’re so glad you’re here! These Terms & Conditions apply to Signature Services offered by NEW Marketing Solutions.
When you book a Signature Service with NEW Marketing Solutions:
We’ll deliver the specific work outlined in your project plan, on the agreed timeline.
You’ll get regular chances to review and provide feedback.
You agree to provide timely input, meet deadlines, and pay invoices within 30 days.
Our flat fee covers the outlined scope — additional charges may apply if the project is delayed, rushed, or grows beyond the original plan.
You’ll own the final work once your final payment clears.
We’ll keep your information confidential and never sell your data.
Either of us can end the agreement with written notice, and any unpaid work can’t be used until payment is complete.

1. Scope of Work & Timeline
What We're Delivering
We’ll complete the work outlined in your Signature Service and determine a timeline during your Strategic Planning Session. You’ll have regular chances to review and give feedback.
If at any point you’re not satisfied and we can’t come to a solution, you’ll pay for everything completed up to that point and we’ll end the contract. Refunds are not available for Services that are under $1K.
Timing & Delays
We aim to stick to the timeline—but life happens. If we anticipate any delays, we’ll let you know ASAP. If delays happen on your end (like missing files or approvals), just keep us in the loop. We’ll adjust the timeline accordingly.
2. Working Together
We’re committed to delivering great work. You agree to provide any needed info or materials and respond in a timely way so we can keep things moving.
3. Payment Terms
Payment Schedule
Your package will be split into equal monthly payments (see your project agreement for details). Invoices are due within 30 days. If applicable, please provide any PO numbers or billing info we’ll need to invoice your organization.
Additional Fees
We charge a flat fee, but sometimes projects need extra time or care. Here’s when additional charges may apply (we’ll always tell you in advance):
Delayed or Dormant Projects: If we haven’t heard from you in 10+ business days, or your project is delayed by more than 30 days, we may charge $500/month past the expected end date. We’ll resume work based on our availability.
Too Many Changes or Late Info: If we spend extra time correcting last-minute or inaccurate info, or making lots of edits beyond the scope, we may charge $100/hour. We’ll let you know first.
After-Hours Meetings: Our hours are M–F, 9AM–5PM CT. We’re happy to meet after hours — just know there’s an additional $100/hour fee.
Last-Minute or Crisis Requests: Projects that require urgent, after-hours work or crisis comms not discussed upfront may be billed at $100/hour.
Outside Vendors: Third-party costs (e.g., printers, videographers, advertising) are not included in our fee. If you’d like us to manage those, we can—admin fee of 10% applies. If you need original design files, we’re happy to provide a quote.
Late Payments
We’re a small business too, so we ask that you stick to payment terms. Payments not made within 30 days may result in:
A pause in work
A $500 reactivation fee
5% monthly interest on past-due balances
If Legal Help Is Needed
If we need to take legal action to collect a payment, you’ll cover the associated costs.
4. Cancellations
You can pause or stop the project at any time. You’ll just need to pay for work completed and any non-refundable expenses we’ve already incurred.
5. Ownership & Usage Rights
Your Content: You confirm that anything you give us to use—photos, text, etc.—you either own or have permission to use.
Final Deliverables: Once your final payment is made, you own the finished product and we’ll hand over the necessary files. We retain ownership of any templates or behind-the-scenes process documents unless otherwise agreed.
6. Confidentiality
We take confidentiality seriously and will treat any private business or customer info with care. We won’t share your information without permission.
7. Ending the Contract
Term & Termination
Either of us can end the agreement with 60 days' notice — or sooner if there’s a breach of agreement, insolvency, or unpaid invoices.
Unused Work
If we’ve completed work you haven’t paid for, you can’t use that work until your account is settled.
Materials Transfer
We’ll return any files or materials you’ve paid for if your account is up to date. You’ll cover any costs to transfer them.
8. Legal Stuff
This agreement is governed by the laws of Cook County, Illinois.
Both parties confirm they have the authority to enter this agreement.
If any part of this agreement is deemed invalid, the rest still stands.
9. Data Use & Privacy
We don’t sell or share your customer data with third parties for marketing purposes. We may use a trusted third-party service to help analyze data for your benefit—but they’ll be bound by strict confidentiality. Let us know if you have any questions before you book.
